Matrimonial Property - Valuation of Superannuation

An actuary's valuation of one or both spouses' superannuation benefits may be required during division of matrimonial assets. If the separation occurred prior to February 2002 the valuation method is governed by the Matrimonial Property Act. Separations after that are governed by the Property Relationships Act 2002.

Broadly, the method is to calculate the benefit due to the member as at the earliest date they would be entitled to retire under the rules of the scheme. The value of this benefit is then discounted back to the date of separation. The benefit is then divided between the parties on the basis of the length of the relationship in the case of separations since February 2002, or the length of marriage prior to that. If the member is already retired, or entitled to do so, then their entitlement is valued at the date of separation.

Fees for a routine valuation start from NZ$350 + GST with the actual fee depending on the complexity of the work required. Valuation of Life Interests and Reversions

Life interests occur when someone is entitled to some benefit which terminates with their death. They commonly occur as the right to occupy a property or dwelling for the rest of the beneficiary's life.

If the parties involved wish to "buy out" the beneficiary's remaining interest then an actuary's report is often required to establish the value.

Valuation of Lost Earnings

Loss of earnings considerations occur when something happens to prevent a person from working at their normal job or occupation when they might have otherwise have expected to. They commonly arise when the person has a serious accident or is unfairly dismissed.
